What does it mean to lead a good life? This anthology examines this question from an interdisciplinary philosophical and theological perspective, assembling contributions from German and international experts. The individual essays are representative of the current state ofresearch. Suitable as an introductory work, the volume surveys the problems that prevail in this area of thought.

In many Western countries, the host society expects immigrants to learn the official language and often reacts in severe ways if they do not. One of the normative questions that arise in this context is whether immigrants have a moral duty to learn the host society’s language. The paper evaluates the four most promising arguments for why immigrants might have such a duty: respect towards the host society; the unavoidability of communication situations involving duties; the duty to avoid becoming reliant (...) on assistance from the welfare system; and a contract between the host society and immigrants. The paper argues that only the third and the fourth arguments support a moral obligation, and that they do so subject to several conditions and only for particular groups of immigrants. (shrink)

This book offers a critical discussion of Joseph Carens’s main works in migration ethics covering themes such as migration, naturalization, citizenship, culture, religion and economic equality. The volume is published on the occasion of the annual Münster Lectures in Philosophy held by Joseph Carens in the fall of 2018. It documents the intellectual exchange with the well-known philosopher Joseph Carens by offering critical contributions on Carens’s work and commentaries of Carens as a reply to these critical contributions. With his various (...) works on migration ethics, Joseph Carens must be seen as one of the leading academics in the political and ethical discourse of migration in the last years. The topic of migration raises questions not only regarding naturalization and citizenship but also cultural, economic and religious differences between aliens, citizens and persons whose status lies in between and calls for further determination. Such questions gain more and more importance in our globalized world as can be seen for example in the context of the refugee crisis in the European Union and the U.S. The book covers different systematic topics of Carens’s work as can be found in his widely read book “The Ethics of Immigration” but also in further publications. It provides papers with critical discussions of Carens’s work as well as his responses to these, thus enabling and documenting the fruitful dialogue between the contributors and Carens himself. The aim of this book is to sharpen and shed light on Carens’s arguments concerning migration by offering new and critical perspectives and fine-grained analyses. (shrink)

Corporate social responsibility in developing countries has recently received increasing attention, and scholars have pointed to the strong contextuality of CSR in the respective regions. Regarding the latter, however, sub-Saharan Africa has been scrutinized only marginally by academia. Moreover, empirical research on the impact of the institutional context has been scant, despite its attributed importance for CSR. Our article seeks to fill a part of this research gap by investigating CSR website reporting of 211 companies in seven sub-Saharan countries. The (...) study’s aim is twofold: First, we identify to what extent sub-Saharan companies report on CSR and which contents they disclose. Second, by building on institutional theory, we investigate how the socio-economic and political environments influence CSR reporting. For this purpose, we examine the impact of country-level and company-level determinants. We find that the sample African companies’ CSR efforts focus strongly on local philanthropy and therefore differ substantially from Western CSR approaches. Furthermore, we evidence that GDP and level of governance standard positively affect CSR reporting. Our study contributes to the literature by empirically evidencing the contextuality of CSR in Africa and by explaining how specific country- and company-level determinants contribute to or hamper the development of CSR in developing countries. When states cooperate in refugee protection and implement a scheme with fixed rules allocating refugees to host states, should they consider refugees' interests and preferences regarding where they receive protection? This article briefly examines the kinds of preferences and interests that are relevant to both refugees and states before discussing the moral principles determining the respective weight that should be attributed to them. We conclude that states must adhere to some minimal constraints concerning the consideration of refugees' concerns, and should (...) promote some further moral goals that go beyond these constraints. Finally, we suggest a scheme that meets all the moral demands we argued for and seems feasible without posing serious threats to the destination states. (shrink)

In his Religious Commitment and Secular Reason, Robert Audi claims that citizens have a prima facie obligation to abstain from support of a public policy that restricts human conduct, unless they are sufficiently motivated in supporting it by adequate secular reasons. The paper argues that Audi fails to give a good justification of this claim. On the one hand, most parts of his justificaction are already covered by the more common claim that citizens should have adequate secular reasons if they (...) support a public policy, thus leaving aside the condition concerned with motivation. On the other hand, there are certain cases where we should not restrict political engagement to secular motivation, because doing so would clearly undermine the goals of a secular political philosophy. Nevertheless, Audi’s claim is correct after all, but for a reason he does not mention himself. Therefore, the paper concludes that it is important to maintain this claim in a restricted version, as religious motivation might lead to non-neutral majority decisions. (shrink)

Although a supposed right to preserve culture is frequently invoked in normative debates, philosophical literature has produced scarcely any attempt to treat it as a particular claim that differs from other cultural rights and, for that reason, is in need of a particular justification. Only by clarifying the content and the normative reasons underlying the supposed right, however, is it possible to evaluate the numerous political claims that have been based on it, ranging from the protection of minorities to restrictions (...) on immigration into nation states. This article argues that the right to preserve culture should be seen as the right of a cultural group to enjoy the framework conditions and to enact supporting political measures that make it likely that its culture will continue to exist through an authentic and continuous path of development. Although some of the possible justifications of that supposed right fail, there is an approach that makes it at least plausible that the right to preserve culture is justified within certain limits. It is widely accepted that Bentham was influenced by the thought of Helvétius. But the fact that Bentham copied some elements from Helvétius leads to the question of how he changed the Helvétian ideas, and in what respects he aspired to go further than Helvétius. Taking as a starting point Bentham's claim that Helvétius was the Bacon of moral science, whereas he himself was to be the Newton, I argue for the following. First, Bentham's theory can be understood as an (...) attempt to work out in detail the theoretical programme that Helvétius outlined in order to reform moral philosophy. Second, in contrast to Helvétius, Bentham's theory is guided by considerations of feasibility, and this leads to claims that are more moderate than Helvétius's claims. Third, whereas Helvétius did not indicate how utilitarian principles should enter political decisions, in Bentham's approach the citizens, and especially philosophers, are considered active political agents. Die Studie prüft, inwieweit Kants Geschichtsdenken auf Elemente christlicher Eschatologie zurückgreift und welche Probleme damit einhergehen. Nach einer methodischen Auseinandersetzung mit Löwith und Blumenberg interpretiert sie Texte Kants, die selten in Ausführlichkeit behandelt werden; sie stellt diese Texte in einen größeren geistesgeschichtlichen Kontext und hinterfragt dabei das Geschichtsdenken der Moderne und der Gegenwart kritisch.

Unter »globaler Armut« wird das Phänomen verstanden, dass Teile der Weltbevölkerung über so wenig Ressourcen verfügen, dass sie ihre Grundbedürfnisse nicht befriedigen können. In der Debatte um globale Armut wird gefragt, wer in globaler Perspektive arm ist; welche Ursachen und welche Folgen diese Armut hat; warum und wie sie bekämpft werden sollte. Die globale Perspektive gibt dabei in drei Hinsichten vor, wie der Armutsbegriff in diesem Kontext zu verstehen ist, und diese drei begrifflichen Festlegungen prägen die gesamte Debatte um das (...) Das Kernanliegen der philosophischen Arbeiten Ludwig Sieps ist die Formulierung einer praktischen Philosophie für die Gegenwart. In seinen jüngeren Arbeiten sind insbesondere der Begriff der Natur und der Begriff der Erfahrung in den Fokus gerückt. Eine plausible Ethik muss nach Siep einerseits eine evaluative Naturbetrachtung und insbesondere eine Reflexion der Natur des Menschen umfassen. Andererseits muss sie aber auch, weil sie sich nicht auf apriorische Prinzipien stützen kann, ein Konzept der historischen Erfahrung heranziehen, wenn sie Antworten auf die heute relevanten (...) Fragen geben möchte. Der Band behandelt anlässlich des 75. Geburtstages Ludwig Sieps zentrale Aspekte seiner jüngeren Arbeiten, teils kritisch und teils mit Vorschlägen für mögliche Weiterentwicklungen. English summary: The validity of human rights is today internationally recognised across nations and cultures. The question as to whether and how their validity can be justified is - on the other hand - a bone of contention. Is this based on legal positivism alone? Or can human rights be understood as moral rights amenable to a kind of justification capable of convincing the skeptic? If so, can such arguments be derived from the tradition of natural law or be defended (...) by means of the laws of reason? Does this require anthropological or metaphysical assumptions - or do discourse-theoretical premises suffice? This volume, which specifically latches onto the traditions of legal positivism, natural and rational law, systematically juxtaposes these questions in a bid for reconciliation. German description: Die Geltung von Menschenrechten ist heute international und kulturubergreifend anerkannt. Die Frage, ob und wie sich ihre Geltung begrunden lassen kann, ist dagegen umstritten: Beruht ihre Geltung lediglich auf positivem Recht?
